These Terms & conditions (“Terms”) govern your access to and use of Petchecka software, websites, and related services (the “Services”). By downloading, installing, accessing, or using the Services you agree to these Terms and to our Privacy policy. If you do not agree, do not use the Services.
Eligibility
You must be able to form a binding contract under applicable law to use the Services. If you use the Services on behalf of an organisation, you represent that you have authority to bind that organisation.
The Services
Petchecka provides tools for pet owners and the carers they trust - friends, family, neighbours, sitters - to coordinate pet-care tasks, voice reminders, acknowledgements, and care requests. Features may vary by platform and by subscription tier. We may modify, suspend, or discontinue parts of the Services with reasonable notice where practicable.
Accounts and security
You are responsible for safeguarding your account credentials and for activity under your account. Notify us promptly at webcontact@petchecka.com if you suspect unauthorised access. To request deletion of your account and associated personal information, follow the steps in our Privacy policy (Account deletion).
Subscriptions and billing
Optional Premium features are offered through in-app subscriptions processed by Apple App Store or Google Play. Premium is sold at US $10 per month or US $100 per year; the price shown in your local store at checkout (which may include taxes and may be adjusted for your currency) is the price you pay. Pricing, renewal, cancellation, and refunds are governed by the applicable platform's terms and by your store-account settings. When you subscribe, we receive subscription status from the platform to unlock features in the Services.
Care requests and the job board
Petchecka offers a job board that lets pet owners post care requests and lets nearby carers accept them. Petchecka is not a party to any agreement between owners and carers. Money, if any, is exchanged off-app between the two parties. You agree that:
- You are solely responsible for evaluating whether to accept or hire any counterparty, for the welfare of pets in your care, and for compliance with local law (including any animal-welfare, licensing, or tax obligations that apply to you);
- Petchecka does not screen carers or owners beyond standard account validation, and does not act as an agent, employer, or intermediary;
- Ratings submitted through the Services reflect the rater's opinion, are subject to our policies, and may be displayed alongside your public profile after both sides have submitted (or after seven (7) days).
Acceptable use
You agree not to misuse the Services. Without limitation, you must not: violate law or third-party rights; attempt to gain unauthorised access to the Services, other accounts, or our systems; interfere with or disrupt the Services; transmit malware; scrape or automate access in a way that burdens our infrastructure; misuse care requests (for example posting illegitimate jobs); or use the Services to send unlawful, harassing, or harmful content.
User content
You retain ownership of content you submit, including pet profiles, tasks, notes, voice recordings, and photos. You grant Petchecka a worldwide, non-exclusive licence to host, process, transmit, and display that content solely as needed to operate and improve the Services for you and for the care-group members you authorise. You represent that you have the rights necessary to grant this licence.
Intellectual property
The Services - including software, branding, documentation, and visual assets - are owned by Petchecka or its licensors and are protected by intellectual-property laws. Except for the limited right to use the Services according to these Terms, no rights are granted to you.
Disclaimer
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, Petchecka disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Services are not a substitute for veterinary, professional, or emergency advice or care. If your pet needs urgent help, contact a qualified veterinarian or emergency service.
Limitation of liability
To the fullest extent permitted by law, Petchecka and its affiliates, officers, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business opportunities, arising from or related to your use of the Services or any interaction with another user through the Services. Our aggregate liability for any claim arising out of these Terms or the Services will not exceed the greater of fifty U.S. dollars (USD $50) or the amounts you paid Petchecka directly for the Services in the twelve months before the claim (excluding amounts paid to app stores). Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the maximum permitted by law.
Indemnity
You will defend and indemnify Petchecka against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Services in violation of these Terms, your dealings with other users, or your violation of law or third-party rights.
Termination
You may stop using the Services at any time. We may suspend or terminate access if you materially breach these Terms or if we must do so to comply with law or protect the Services and our users. Provisions that by their nature should survive will survive termination.
Governing law
These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles, except where prohibited by applicable consumer-protection rules in your jurisdiction. Courts located in California will have exclusive jurisdiction for disputes, unless applicable law requires otherwise.
Changes
We may update these Terms from time to time. We will post the updated Terms on this page and revise the effective date. Continued use after changes become effective constitutes acceptance of the revised Terms.
